In conjunction with the U.S. Consumer Product Safety Commission (CPSC), five retailers are halting sales of the Tots in Mind, Inc. crib tents and play yard tents and a voluntary recall is now being issued. The CPSC is urging parents and child caregivers who own these products that toddlers and infants are at risk for injury or death due to the strangulation and entrapment hazards presented by these items. The CPSC is aware of 27 tent failures between January 1997 and April 2012, including one fatality and one catastrophic brain injury, from the crib tents and play yard tents.

As Tots in Mind, Inc., the manufacturer of these items, is no longer in business, the retailers who sold these recalled products have stepped up and are issuing refunds or store credits to consumers. Consumers should contact the stores where the product was purchased to receive either the refund or store credit, which is dependent on the retailer. Information on the retailers and how they can be reached is below:

Amazon: Amazon.com

Bed, Bath, & Beyond/BuyBuyBaby: (800)-GOBEYOND, bedbathandbeyond.com, or buybuybaby.com

Burlington Coat Factory: (888) 223-2628, burlingtoncoatfactory.com

Walmart: (800) 925-6278, walmartstores.com

Toys R Us/Babies R Us: (800) 869-7787, toysrus.com, or babiesrus.com

The recall includes various models of approximately 330,000 crib or play yard tents. Consumers can identify their tent by the Tots in Mind logo label located on the non-mesh portion near the top of the tent. The CPSC advises parents and caregivers to stop use of the product immediately.

Families and child caregivers trust that the products and toys intended for children are safe and harm-free, but when a manufacturer fails to adequately test a product for safety or has insufficient manufacturing standards, an innocent child may suffer injury or even death. The product liability lawyers in Chicago at the Bradley Law Firm are committed to helping families across Illinois receive the compensation they need following a devastating child injury accident. To discuss your case with a member of our law team, call (312) 252-1488.

According to a MadisonRecord.com report, an Illinois woman is suing both her doctor and a Maryville hospital claiming she was injured during a hysterectomy. The woman was admitted to Anderson Hospital in April 2010 for a total abdominal hysterectomy, but the woman’s complaint notes that the doctor performing the surgery and the hospital staff made several mistakes during surgery, including failing to treat both a strangulated bowel and an incisional hernia. The complaint also contends that conditions in the operating room caused her to contract a serious staph infection.

The lawsuit was filed April 27 in St. Clair County Circuit Court. The former patient is accusing the hospital and doctor of medical negligence and is seeking more than $225,000 in damages for medical bills, court costs, and loss of income.

Surgical errors are listed among the National Quality Forum’s events that should never take place in a healthcare setting. Though surgical errors are not something a patient can control, there are a few things patients can do to help prevent a dangerous surgical mistake. Patients should: thoroughly discuss the procedure with their surgeon; if fitting, use an indelible marker to mark the appropriate area of the body for the surgery; and consider asking the anesthesiologist if you can stay awake during your procedure so that you may be able to ask questions and monitor what’s going on.

A surgical error can severely injure a patient and affect his or her well-being, and when medical professionals fail to administer the proper care to patients, a knowledgeable Chicago medical malpractice attorney can help hold negligent parties responsible for their actions. At the Bradley Law Firm, we have extensive experience with medical malpractice cases and can help you obtain the compensation you deserve. Call (312) 252-1488 for a free case evaluation.

Though motorcycle enthusiasts enjoy their vehicles year round, the warmer weather months in Illinois will certainly mean extended trips to revel in the scenery of the Prairie State. As the month of May is Motorcycle Safety Awareness Month, it is an excellent time to remind motorcyclists of the basic safety tips that may help prevent a dangerous IL motorcycle accident.

In honor of Motorcycle Safety Awareness Month, here are four simple motorcycle safety tips to remember before you hit the open road:

Prepare your bike: Give your motorcycle a thorough inspection to ensure all equipment is working properly, such as the bike’s brakes, lights, and turn signals. Also, be sure to check fluid levels and the motorcycle exhaust.

Increase your visibility: Visibility is key for a motorcyclist’s safety, so wear bright clothing and consider keeping your lights on in the daytime to increase visibility and ensure other motorists can see you. In addition, always keep a safe distance between you and other vehicles.

Take a safety course: Brushing up on your riding skills is essential to being a safe rider whether you are experienced or just starting out, particularly with constantly changing laws and road conditions. Consider taking an American Motorcyclist Association (AMA) safety course to polish your skills.

Invest in quality safety gear: Good motorcycle safety gear can save a rider’s life in the event of a crash, so keep these selection tips in mind: choose a properly fitting helmet, leather is the best material for jacket and pants because of its durability, use non-slip gloves, and wear shoes or boots that cover your ankles.

Motorcyclists who drive with safety in mind and amply prepare before a trip can reduce their chances of being in a serious crash; unfortunately, not all accidents can be prevented. If you have been involved in a motorcycle accident caused by another’s negligence, contact a skilled Chicago motorcycle accident attorney at the Bradley Law Firm for assistance with your case. Call (312) 252-1488 to schedule a complimentary consultation.

According to a Fox News report, highway deaths in the U.S. have a reached a record low. Preliminary government data released shows that highway fatalities declined in 2011, reaching their lowest rate when compared to miles driven since such record-keeping began in 1921. An early estimate by the National Highway Traffic Safety Administration (NHTSA) reveals that traffic accident fatalities in 2011 totaled 32,310, which is a 1.7 percent drop from the prior year. Overall, it is the lowest number of deaths in more than 60 years. In addition, traffic fatalities have significantly decreased in the past decade, dropping 26 percent since 2005.

Safety experts are attributing the record low numbers and significant decline to a number of factors, including more people wearing their safety belt, less driving being done due to the weak economy, increased efforts to curb drunk driving, and better safety equipment and features in vehicles. The NHTSA states that the number of miles driven in the U.S. declined in 2011 by 1.2 percent, or 35.7 billion miles, and data shows that there were 1.09 deaths per 100 million miles traveled. This is a slight decrease from the 1.11 deaths in 2010. The group affirms this is the lowest rate on record.

While these new statistics are excellent news for motorists, it is still the responsibility of all drivers to ensure the safety of others on the road by driving safely, alertly, and distraction free. However, if a driver does cause an auto accident, it is important to know that victims can legally pursue compensation from anyone deemed at-fault for the crash. For reliable representation in your motor vehicle accident case, contact a Chicago traffic accident attorney at the Bradley Law Firm. Call (312) 252-1488 to schedule a free consultation.

Cases of nursing home abuse and neglect are unfortunately an increasing problem in residential care facilities across the U.S. Experts believe that for every one case of nursing home abuse or neglect, about five more go unreported, but studies estimate that between one and two million Americans ages 65 years and older have been exploited, neglected, or mistreated by someone they depend on for care. As an Illinois nursing home abuse attorney, Ryan Bradley understands how devastating it can be for loved ones to discover that their relative or friend has been abused and how traumatic abuse or neglect is for the victim.

In order to help those who have an elderly loved one in a care facility prevent abuse, it is essential to understand the different types of abuse that may occur. Here is more information on four types of abuse that may occur in a nursing home:

Nursing home neglect: When the staff of a care facility neglect residents and do not fill their primary care duties, this is considered neglect. Examples include not providing residents with clean surroundings, over medication, not maintaining proper hygiene for residents, or deprivation of food and water.

Emotional and mental abuse: Any verbal or physical act that results in emotional suffering, pain, or anguish constitutes this type of abuse. This can include insulting, intimidating, or threatening residents, all of which cause emotional and mental distress.

Sexual abuse: Sexual abuse occurs when any type of sexual activity is carried out without the consent of the resident and is done to satisfy the abuser.

Physical abuse: Physical abuse, which can be in the form of hitting, slapping, shoving, or other physical action which causes harm, sadly occurs at the hands of those who are supposed to be providing care. Be aware of the signs of physical abuse, such as unexplained bruises, cuts, scratches, or broken bones.

When you find out your elderly loved one has been the victim of abuse, it can be extraordinarily upsetting and a confusing time for your family, but it is important to know you have legal rights. Chicago nursing home abuse lawyer Ryan Bradley and the legal team at the Bradley Law Firm are dedicated to protecting the rights of nursing home abuse victims and will work to hold at-fault parties responsible for the harm caused. To discuss your case with us confidentially, call (312) 252-1488.

Two suffered minor injuries after a prisoner bus collided with another prisoner bus on the Stevenson Expressway, according to WLSAM.com. Three buses were transporting 106 detainees from the Cook County Jail to Stateville Prison around 8 a.m. on April 27 on the outbound Stevenson, just south of Pulaski. A fourth bus was also part of the convoy in the event that one of the other buses suffered a mechanic failure. One of the buses was not able to stop in time as traffic slowed on the expressway, and it struck the lead bus.

One police officer and one detainee endured only minor injuries as a result of the crash, and both were taken to Mount Sinai Hospital for treatment. The remaining 105 detainees were put back on the buses to go back to Cook County Jail to ensure they were not injured, and will then get back on the road to Stateville Prison.

An investigation is forthcoming. A spokesman for the Cook County Sheriff’s Office explains that the buses used to transport detainees are equipped with new technology that will enable investigators to see if there was anything going on in the bus that may have effected its ability to stop or something the driver could have done to prevent the collision, which will aid in the official investigation.

Bus accidents can cause very serious injury to the vehicle’s occupants, and when the collision was caused by another person’s negligent actions, the injured party has the legal right to pursue compensation from those responsible. An experienced bus accident attorney in Chicago at the Bradley Law Firm can help if you have been injured in an IL bus crash.

Any accident that involves head trauma is very serious, and there are a number of different types of head injuries that a person may endure. One specific type is a closed head injury, which is any injury to the head that does not penetrate the skull. A closed head injury is typically caused by a blow to the head, and it often occurs as a result of an assault, a fall, or a traffic accident. There are unfortunately several risks associated with this type of injury; for example, a strong blow can cause brain swelling, which can lead to permanent brain damage.

There are a few different types of closed head injuries, and the extent of the patient’s brain damage will depend on the severity of the injury. This type of injury can range from mild to severe, and can lead to serious brain damage or perhaps even be fatal. Here is information on four different types of closed head injuries:

Concussion: A concussion is a type of head injury that may temporarily affect normal brain functions. Most tend to be mild and do not cause loss of consciousness.

Diffuse axonal injury: A very debilitating type of traumatic brain injury that can cause permanent damage to the nerves in the brain. This injury is often caused by high speed transportation accidents.

Brain contusion: A brain contusion is bruising of the brain tissue that occurs due to brain trauma. These are present in 20 to 30 percent of severe head injuries.

Intracranial hematoma: This occurs when a person’s brain is forced against the inside of the skull. The three types include: epidural, subdural, and intraparenchymal.

A closed head injury can require costly treatment, including surgery, and even extensive rehabilitation for a patient to regain basic motor and cognitive skills. If you have suffered from a closed head injury that was caused by another party’s negligent actions, you can legally pursue compensation from the at-fault person and a closed head injury lawyer in Chicago at the Bradley Law Firm can help.

As the mercury rises, Illinois residents are eagerly awaiting warmer temperatures and planning what fun summer activities to do under the sun. Recreational boating is a popular and enjoyable way to spend time on the state’s beautiful rivers and lakes, but boating safety is essential and it is imperative for boaters to remember basic safety tips. According to 2003 data from the United States Coast Guard, of the nearly 13 million registered boats, 5,438 boating accidents were reported, which caused 703 fatalities, 3,888 injuries, and more than $40 million in property damage.

There are a number of things that may cause an IL boating accident, but understanding some of the more common causes can help you avoid a dangerous mishap on the water. Here are some of the factors that commonly cause a high seas accident:

Alcohol: More than one-third of all boating accidents involve a driver who is under the influence. In addition to being dangerous, all states penalize boaters who are under the influence and a person may face hefty fines or imprisonment.

Boater inexperience: Boating accidents are very likely to occur when an inexperienced boater encounters conditions that are dangerous or unfamiliar. Boating safety classes can help novice boaters understand their boat and the necessary safety rules to follow.

Inclement weather: Severe weather can absolutely cause a boating accident. Examples of severe weather include strong winds, heavy rains, sunlight (which can cause heat exhaustion), or lightning (which can electrocute passengers).

Carbon monoxide: A boat’s engine can produce carbon monoxide which can cause death or serious illness if those on board are exposed to a high enough concentration.

The inquiry covers almost 122,000 BMWs from the 2002 to 2008 model years. During the eight-month investigation, which began in August, safety regulators have discovered 16 crashes and five injuries caused by the vehicle’s transmission control problems. The cars have a push-button start and electronic transmission controls, and in some cases owners believed their car was in park when it was actually in neutral. The NHTSA states in its reports that, basically, the car may roll away unexpectedly and crash due to the alleged defect.

The NHTSA has officially upgraded the BMW inquiry to an engineering analysis, which brings it one step closer to a recall, in order to further “assess the potential safety consequences of the alleged defect.” Documents from the safety agency indicate that BMW has received 50 complaints about the problem. In one complaint, the driver of a 2002 745Li said the car was parked at a daycare center near Atlanta when it rolled approximately 40 yards and crashed into a nearby embankment. Another instance saw a driver’s parked vehicle, a 2006 750 BMW, roll backward about 100 feet and crash into a lamppost. Fortunately, no one was injured in either case.

BMW has thus far been unable to diagnose the failure, and the automaker is fully cooperating with the NHTSA’s investigation.

Automobile makers have the responsibility to produce a vehicle that is completely safe for consumer use. One small defect, however, can cause a deadly accident and cost an innocent person his or her life. If you have been injured by a defective auto part, seeking legal assistance from a skilled Illinois product liability lawyer can help ensure your rights are protected throughout your case. At the Bradley Law Firm, we are dedicated to helping consumers harmed by a dangerous product obtain compensation for their injuries and losses.

The State Journal-Register reports that a semi truck crash in Springfield slowed traffic for approximately two hours on April 11. According to Illinois State Police, the semi was traveling northbound on Interstate 55 at 10 a.m. when the driver went off the road and proceeded to plow through the center median. The semi, operated by a 25-year-old driver from Indiana, then crashed into a flatbed that was being pulled by a pickup truck heading northbound. The pickup truck was driven by a 52-year-old resident of Champaign.

Following the collision, the big rig drove down an embankment near the Stevenson Drive exit and southbound lanes of the highway. The 25-year-old semi truck driver told police that his truck began pulling to the left for an unknown reason, and a safety inspection on the large vehicle is pending. Both vehicles involved in the collision were towed from the scene of the accident and the semi driver was cited for improper lane usage. Traffic was significantly slowed on the southbound side of I-55 as authorities cleaned up the crash.

Truck accidents can be caused for a number of reasons, including improper maintenance and faulty inspections. When a truck crash is caused by the negligence of another, the truck accident victim has the right to pursue compensation from any at-fault parties.
