Chicago Cell Phone Car Accident Lawyers

Text Messaging Law

According to Illinois Vehicle Code 12-610.2 (b): "A person may not operate a motor vehicle on a roadway while using an electronic communication device to compose, send, or read an electronic message." This law does not apply to drivers reporting an emergency or drivers utilizing hands-free or voice-activated devices.

School Zones and Maintenance Zones

Drivers may no longer use cell phones in certain safety zones. Illinois Vehicle Code Section 12-610.1 (e) states: "A person, regardless of age, may not use a wireless telephone at any time while operating a motor vehicle on a roadway in a school speed zone established under Section 11-605, or on a highway in a construction or maintenance speed zone established under Section 11-605.1.12."

Cell Phone Restrictions

Illinois still allows most drivers to make phone calls while on the roadway. This freedom is not afforded for drivers under the age of 19 or permit holders 18 years old or younger. It is also illegal for school bus drivers to use a cell phone while driving. All cell phone laws in Illinois are considered primary offenses. This means that police may pull you over for breaking these laws and issue a citation without any other cause.

Despite these legal attempts to crack down on distracted driving, cell phone auto accidents continue to be a serious problem in the United States. A recent study by HealthDay News showed that 5,870 people were killed in cell phone and texting related car accidents in 2008.
